In addition to intellectual property, I provide services related to wrongful dismissal.
In Canada, an employer has the right to dismiss an employee with or without cause. There are several prohibited grounds (mostly related to discrimination issues) for dismissal.
If an employer fires an employee, and the ground for dismissal is not one of the prohibited grounds, then the only condition for dismissal (unless the employment agreement states otherwise) is that the employer gives the employee sufficient notice or pays the employee for the duration of such notice. The term of the notice is determined based on the employment agreement (if it exists and if it does not contradict the mandatory requirements of the law), provisions of the Employment Standards Act and case law.
I provide the following services related to employment:
- Consultations on legality of dismissal and the terms of the severance package;
- Working out a legal strategy in employment disputes;
- Drafting cease-and-desist letters;
- Drafting court documents;
- Representing employers and employees in court (Supreme Court and Small Claims Court);
I also provide legal services relating to general commercial contracts and disputes:
- Drafting and revision of general commercial contracts (service agreements, sale and purchase agreements, franchising, agency agreements, etc.);
- Representing companies and individuals in courts in cases relating to breach of contract (Supreme Court и Small Claims Court);
- Representing companies and individuals in courts in cases relating to voidance and enforceability of terms of contracts (Supreme Court и Small Claims Court);
- Representing companies and individuals in courts in cases relating to misrepresentations and fraud (Supreme Court и Small Claims Court).
